South Centre hails Indian drug patent decision

"The ruling by the Supreme Court of India dismissing the petition from Novartis AG is a historic decision with positive global implications ... The Novartis AG application had claimed a patent for a new salt form (imatinib mesylate), a medicine for the treatment of chronic myeloid leukemia. Novartis sells this medicine in several countries under the brand name Glivec (Gleevec). The Indian patent office had rejected the patent application on the ground that the claimed new form was anticipated in a US patent of 1996 for the compound imatinib and that the new form did not enhance the therapeutic efficacy of the drug. The decision was upheld by the Indian Patents Appellate Board (IPAB).

The decision by the Supreme Court of India has significant positive global implications. It has effectively protected the leading role of India in supplying affordable medicines to other developing countries. The reaffirmation of the primacy of health and access to medicines as a right of citizens is particularly important for the international community when these rights are under significant threat under bilateral trade and investment agreements."

Indian court rejects Novartis patent

German Velasquez, a special adviser for health and development at South Centre, a think tank based in Geneva, Switzerland, says he hopes that “many developing countries will follow India’s example to protect the rights of their populations to have access to essential medicines”. A 2011 study by South Centre found evidence of “a significant proliferation of patents on developments of incremental nature” in Argentina, Brazil, Colombia, India and South Africa.

Concept Paper by South Centre on High Level Political Forum on Sustainable Development (HLPF)

1. Introduction: The HLPF is one of the most important outcomes of Rio+20, and perhaps its most important. It provides UN member states with the opportunity to set up an architecture that is effective and that can meet up to the present challenges in sustainable development (including the present multiple crises in the economic, social and environmental areas) and the even larger challenges that loom in the future. This concept note examines the functions mandated by Rio+20 for the HLPF and how these functions can be implemented, including the structural issues (high-level events, committees, secretariat, etc), the types of meetings and time required for them, the need for a dedicated body, the national and regional institutions and activities, and the arrangements for meeting the mandated functions. The areas required to be covered are many; this concept note is a preliminary attempt to provide views on some of the issues.

Not making the cut

Canada has now opted out of Kyoto, emulating the US, while Russia, Japan and New Zealand have refused to make cuts. The European Union, the most proactive by promising to cut emissions by 20% by 2020, rising to 30% if the US comes on board, is now backtracking. All that the first phase of Kyoto compelled industrial countries was to cut 5% by 2008-12, which has been honoured more in the breach. The Geneva-based South Centre put it tellingly: “If you are adamant in doing away with the life in the body, at least make sure there is a proper allocation of its property and continuity of its heritage, and then give it a proper burial.”

Seeking ethical FDIs

« Caractéristiques d’un possible mécanisme de règlement de la dette »

M. MARTIN KHOR, Directeur exécutif du Centre du Sud, a relevé que, dès qu’un pays commence à expérimenter des difficultés dans le règlement de sa dette extérieure, il est coupé de toute nouvelle source de financement, même en ce qui concerne son accès aux crédits commerciaux.  Il a donc proposé un mécanisme permettant d’interrompre temporairement toute procédure de recouvrement de la dette, afin de donner le temps aux pays et aux acteurs qui s’occupent de leur endettement de trouver une solution.  Cette décision serait prise par un groupe d’experts indépendants, a suggéré M. Khor.  Un pays endetté pourrait ainsi suspendre unilatéralement ses paiements sans risquer d’être attaqué par ses créanciers.  Le pays endetté pourrait cependant bénéficier d’un nouveau prêt, qui serait accordé par exemple par le Fonds monétaire international (FMI), afin de pouvoir poursuivre ses activités commerciales.  Ce nouveau prêt permettrait aussi à ce pays d’éviter la fuite de capitaux qui se produit généralement en cas de perspective de défaut de paiement de dette.  M. Khor a suggéré de donner un autre statut aux nouvelles dettes que pourraient contracter les pays.

Poorer countries seek assurances on technology transfer after Rio+20

Rio+20 prevented reversal, salvaged key multilateral principles, concludes UNCTAD workshop

Rio+20 Climate Talks Finish With Little IP; Flexibilities Under Fire

Regarding Africa, while the WTO maintains its long-standing opinion and says that trade among African countries is too low and “stagnant”,  experts at the South Centre, an inter-governmental think tank of developing countries, stressed  last week that trade is significant in manufactured goods and seems to be leading to a new path to industrialisation.

The Geneva-based South Centre, however pointed out that intra-African trade is low “in absolute terms”: "In terms of non-oil exports Africa's internal trade is almost on par with its exports to the EU […] the trade growth rate within Africa is the second highest after China and before the United States and the EU . Therefore, it is very promising, also in terms of the quality of exports. Most of Africa's manufactured goods go to Africa. So if the continent wants to industrialise, the market that provides the best opportunities is Africa, not China, the U.S., or the EU."

Khor s’est également interrogé sur les moyens qui permettraient de mieux utiliser les ressources des Nations Unies.  Le développement durable ne doit pas affaiblir le rôle que doit jouer chacun de ses piliers, mais, au contraire, le renforcer.  Il faut accorder la même importance aux trois dimensions du développement durable –économique, sociale et environnementale-, a-t-il insisté.  « Nous sommes sur le point de nous lancer sur un programme de grande envergure », a-t-il assuré.  Pour garantir le succès de la Conférence de Rio+20, a-t-il ajouté, il faudrait, au préalable, régler les problèmes institutionnels.

Conference on management of economy commence at LSE

The opening session of the Conference focused on A Heterodox Strategy for Stabilisation and Economic Growth. The first speaker, Dr Irfan ul Haque, Special Advisor, Financing for Development, South Centre, Geneva, remarked that a strategy for accelerated growth for Pakistan is both necessary and feasible as Pakistan’s macroeconomic conditions are broadly similar to some of its more rapidly growing neighbours. In light of this, Dr Irfan proposed a Heterodox Scenario, which showed that macroeconomic adjustments can be phased over the next few years and will be easier to make if the economy were to grow more rapidly. He, however, stressed that for accelerated growth to materialise, as a minimum, determined steps are needed to overcome the energy crisis, sharply raise the investment rate (particularly, private investment), and strengthen Pakistan’s competitiveness in the world market.

 Is the staggering rise of the South sustainable?

APRIL 2012, 2012 (IPS) - Growth in developing economies (DEs) has accelerated significantly in the new millennium. Whereas in the 1980s and 1990s their average growth was barely higher than that of advanced economies (AEs), from the early years of the 2000s until the global crisis, the difference shot up to 5 percentage points. It widened further during 2008-11 with the collapse in AEs. Although there is diversity, the acceleration is broad-based with all developing regions enjoying faster growth than in the past. The notable exception is China, which has grown in the new millennium at broadly the same (albeit rapid) pace as in the 1990s, writes Yilmaz Akyuz, chief economist of the South Centre, Geneva.

Day Marked By Initiatives On The Benefits Of IP, Open Technology

In another action today, the South Centre, a developing country intergovernmental group, released “IPR, R&D, Human Rights and Access to Medicines – An Annotated and Selected Bibliography.”

The bibliography is intended to help provide “the appropriate technical assistance and country support to developing countries, within a comprehensive and coherent national IP strategy, to promote implementation of the TRIPS Agreement that is consistent with the protection of public health and promotion of access to medicines,” the centre said in a release.

“The growing volume of literature being produced around the issue of IP, R&D, human rights and access to medicines in the last five years can help countries to find the opportunities and room to manoeuvre to protect the citizens of developing countries from the unhealthy environment created by the new international trade rules,” the Centre said.

The bibliography of selected references was created by Germán Velásquez, Carlos Correa and Xavier Seuba and is available on the South Centre website, here.

Many people go to India to buy life-saving generic medicines from pharmacies and bring these back in suitcases to give to close relatives who cannot afford the expensive branded original products.

Killing the messenger

The impasse in the proceedings of Unctad has relatively recent origins. Martin Khor, executive director of South Centre, a Geneva-based policy think tank of developing countries, points out that while developed countries have tried to curb the pro-South orientation of the Unctad secretariat and its many reports over the last two decades, this “unhealthy trend seemed to have subsided in the past decade, but in the past two months, during the meetings in Geneva to prepare for Unctad XIII, some developed countries have reportedly attempted to dilute the areas of future work of Unctad, to the frustration of the G77 (Group of 77 developing countries) and China”.

Women of the World Unite for Rights

"Many people say this is a time for transformation and moving forward but we know from our work that it’s also a time of instability and uncertainty," Jamaican activist Mariama Williams, a senior programme officer at the South Centre, said at the closing session of the 12th International Forum on Women’s Rights and Development in Istanbul.

The WHO’s Final Sprint Toward An International Convention On R&D

The intergovernmental South Centre issued a statement that “the negotiation and adoption of an international instrument that promotes pharmaceutical R&D that addresses the needs of developing countries would be a key element for the implementation of the GSPA-PHI,” referring to the Global Strategy and Plan of Action on Public Health, Innovation and Intellectual Property agreed at the 63rd WHA.

“Unctad is extremely important for developing countries,” he explains, adding that “another factor that operates in Geneva is the South Centre, established by (the late Tanzanian President) Julius Nyeyere”.

He said a total of 180 out of 330 public corporate and industries were privatized to local investors and only 23 were privatized to foreign investors and that the government gave out shares of the remained corporations and industries. According to Vicente Yu, coordinator for the Global Governance for Development Programme at the South Centre, an intergovernmental organisation of developing countries, “for developed countries, UNCTAD’s work on IP issues, if any, should be focused on IP enforcement consistent with the work of WIPO. But for developing countries, the focus of UNCTAD’s work on IP issues should include looking at the developmental aspects of IP, including the use of IP flexibilities and ensuring that IPRs do not become barriers to technology transfers that are needed for their development.”

“For developing countries, UNCTAD XIII is an opportunity for the global community through UNCTAD to provide a clear analysis of the major development challenges that still need to be addressed and how UNCTAD can contribute to addressing these,” he told Intellectual Property Watch. “In this regard, it is important for UNCTAD to retain its ability to provide macroeconomic policy research and analysis that are heterodox and ahead of the curve particularly in areas of multilateral policymaking that affects the development prospects of developing countries,” such as trade, debt, commodities, or global economic governance reform.

“For developed countries,” Yu said, “UNCTAD XIII will be an opportunity for providing a specific and focused mandate for UNCTAD’ work, in pre-defined technical areas, such as investment liberalization policy, competition policy, trade liberalization policy, especially in providing technical assistance that complements those provided by other institutions such as the World Bank and the WTO.”

The South Centre is an intergovernmental organisation serving as a multilateral policy research institution for developing countries. It was established in 1994. The South Centre’s membership is composed of 51 developing countries.

Africa: EU Vying for Resources with Emerging Economies

East Africa: Mkapa Cautions EAC On Economic Partnership Agreements

Mr Mkapa, who is the current chairman of the South Centre, was addressing a high level meeting on EPA negotiations, taking place at Ngurdoto Mountain Lodge in Meru District. The workshop is organized under the auspices of the Arusha-based, East African Community (EAC) Secretariat.

"Study by the South Centre shows that the EAC already has a "hubs and spokes" trade relation to the European Union in which only 6 per cent of our total exports are in form of manufactured processed goods whilst 94 per cent of exports are primary products, mainly raw materials," he said.

Tanzania: Invest in Technical Studies, Mkapa Urges Colleges
